These Terms of Service ("Terms") govern your use of Velocity: Speedometer ("Velocity," "the App"), developed by Seampli LLC ("Seampli," "we," "our," or "us"). By downloading, installing, or using Velocity, you agree to these Terms. If you do not agree, do not use the App. Please also review the Velocity Privacy Policy, which is incorporated into these Terms by reference.

Important Safety Notice

Keep your eyes on the road, not on the App.

Do not interact with Velocity while operating a vehicle. Velocity displays speed, altitude, and weather for informational and recreational purposes only. Looking at your phone while driving, cycling, or riding is dangerous and may be illegal where you are.

Velocity is not a substitute for your vehicle's speedometer or for any official, certified, or legally required instrument. Always obey posted speed limits and all traffic laws, and rely on your vehicle's own instruments and your own judgment for any safety-critical or legal decision.

Acceptance of Terms

By accessing or using Velocity, you confirm that you can form a binding contract with Seampli, that you accept these Terms, and that you agree to comply with them and with all applicable laws and regulations. If you are using the App on behalf of another person, you represent that you are authorized to accept these Terms on their behalf.

Not a Navigation or Safety Device

Velocity is a consumer informational and recreational app. It is not a navigation system, not a certified speed-measuring instrument, not a safety device, and not a substitute for the instruments built into your vehicle.

The App does not provide turn-by-turn directions, collision warnings, hazard alerts, or any safety-critical function. Do not rely on Velocity for any purpose where inaccuracy, delay, or unavailability could contribute to injury, loss, or a legal consequence.

Driver and Road Safety

You are solely responsible for operating any vehicle safely and lawfully. By using Velocity, you agree that:

Velocity does not encourage, condone, or reward speeding or unsafe operation of any vehicle. Any decision about how fast to travel is yours alone and your responsibility alone.

GPS and Information Accuracy

Velocity derives speed, altitude, and route from your device's GPS and motion sensors, and displays weather from Apple WeatherKit. The accuracy of all of this depends on factors outside our control, including satellite signal quality, your surroundings (tunnels, tall buildings, canyons, dense foliage, indoor spaces), weather, device hardware, and iOS system conditions.

As a result, values may be delayed, imprecise, or temporarily unavailable. Altitude in particular is sensitive to conditions, and the optional Battery Saver mode intentionally reduces GPS accuracy to extend ride time. Weather is provided by Apple and reflects Apple's data for your general area, not your exact position. Do not rely on any value in Velocity where accuracy matters for safety, legal, financial, or medical decisions.

Assumption of Risk

Any physical activity tracked with Velocity — including driving, motorcycling, cycling, running, skiing, boating, or any other movement — carries inherent risks. You voluntarily assume all risks associated with these activities and with your use of the App. You are responsible for your own physical condition, your equipment, your environment, and your compliance with all applicable rules and laws. Velocity's role is limited to displaying and recording information; it does not make any activity safe.

Battery, Background Use & Mounting

Velocity uses GPS, including in the background during an active trip, which consumes battery faster than typical app use. You are responsible for ensuring your device has sufficient power for your needs, particularly on longer rides. Battery Saver mode is offered to help extend ride time at the cost of reduced accuracy.

If you choose to mount your device in a vehicle, you are responsible for doing so safely and lawfully, in a position that does not obstruct your view or controls, and in accordance with your device manufacturer's guidance and local law. Exposure to direct sun, heat, or vibration in a mount can affect your device; any resulting damage is your responsibility, not Seampli's.

License and Permitted Use

Subject to these Terms, Seampli grants you a limited, non-exclusive, non-transferable, revocable license to use Velocity for personal, non-commercial purposes on devices you own or control. You agree not to:

Apple WeatherKit & Attribution

Weather and wind information in Velocity is provided by Apple WeatherKit and is subject to Apple's terms and data. The Apple Weather trademark and logo shown in the App are the property of Apple Inc. and are displayed as required by Apple's attribution requirements. Seampli does not generate, verify, or guarantee weather data, and is not responsible for its accuracy, timeliness, or availability.

Weather features may be temporarily unavailable. The weather and wind features depend on Apple WeatherKit, a third-party service accessed under usage limits set by Apple. Weather data may be delayed, incomplete, or unavailable from time to time, including but not limited to: when network connectivity is lost, when location is unavailable, when Apple's service is interrupted, or when applicable WeatherKit usage limits or quotas are reached. During any such period, the weather and wind elements of the App may show no data or a status message, while the speedometer, altitude, and ride-tracking features continue to function. Temporary or intermittent unavailability of weather is expected behavior and does not constitute a defect, a breach of these Terms, or a basis for any claim or refund. Seampli does not guarantee continuous availability of the weather features and may change, limit, or discontinue them at any time.

Third-Party Services

Velocity is distributed through Apple's App Store and uses Apple-provided frameworks and services, including Apple WeatherKit. Your use of Apple's platforms is governed by Apple's own terms. We are not responsible for the availability, security, or behavior of Apple's platforms, nor for any downtime, outages, or changes Apple may introduce.

Apple as Third-Party Beneficiary

You acknowledge that these Terms are entered into between you and Seampli LLC, not between you and Apple Inc. ("Apple"), and that Seampli — not Apple — is solely responsible for Velocity and its content. Apple has no obligation to furnish maintenance, support, warranty service, or any other assistance with respect to Velocity.

In the event of any failure of Velocity to conform to any applicable warranty, you may notify Apple, and Apple will, where applicable, refund the purchase price of the App to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Velocity.

Seampli, not Apple, is responsible for addressing any claims by you or any third party relating to Velocity or your use of it, including but not limited to: (a) product liability claims; (b) any claim that Velocity fails to conform to any applicable legal or regulatory requirement; (c) claims arising under consumer-protection, privacy, or similar legislation; and (d) any third-party claim that Velocity or your use of it infringes that party's intellectual property rights.

You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist-supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

User Responsibilities

Violation of these Terms may result in suspension or termination of your access to the App.

Intellectual Property

All content, software, source code, design, graphics, layout, copy, and other materials in Velocity are the property of Seampli LLC or its licensors and are protected by U.S. and international copyright and other intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works of any of these materials except as expressly permitted by these Terms or by applicable law. Ride data you generate in the App remains yours.

Disclaimer of Warranties

Velocity is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Seampli disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components, nor that any speed, altitude, distance, route, or weather value in the App is accurate, complete, or suitable for your circumstances.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Seampli LLC, its officers, members, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use Velocity, or any driving, riding, or other activity, accident, citation, injury, or loss associated with such use, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Seampli has been advised of the possibility of such damages.

In no event shall the total aggregate liability of Seampli arising from or related to Velocity exceed the greater of (a) the total amount you paid Seampli for Velocity in the twelve (12) months preceding the claim, or (b) one hundred United States dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, these limitations apply to the maximum extent permitted by law.

Release of Claims

By using Velocity, you, on behalf of yourself and your heirs, representatives, and successors, release, waive, and forever discharge Seampli LLC, its members, officers, employees, contractors, and affiliates from any and all claims, demands, actions, and causes of action — whether known or unknown, suspected or unsuspected — arising out of or related to any driving, riding, or other activity, accident, traffic citation, injury, or harm experienced in connection with your use of the App.

This release applies to the fullest extent permitted by applicable law and survives the termination of these Terms and your use of the App.

Indemnification

You agree to indemnify, defend, and hold harmless Seampli LLC, its members, officers, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of Velocity; (b) your violation of these Terms; (c) your violation of any applicable law, including traffic laws; (d) your infringement of any third party's rights; (e) any accident, citation, injury, or harm resulting from any activity undertaken while using the App; or (f) any damage to your device, accessories, or property resulting from your use or mounting of the device while using the App.

Purchases and Subscriptions

Velocity is currently offered free of charge. The App contains no in-app purchases, no subscriptions, no paid tiers, and no advertising. Seampli does not collect payment information from you.

If paid features, subscriptions, or in-app purchases are introduced in a future update, the applicable terms (including pricing, billing, renewal, and refund handling through Apple) will be presented in the App and on the App Store before any purchase, and these Terms will be updated accordingly. Until that happens, this section reflects the App's full commercial state.

Termination

We may suspend or terminate your access to Velocity at any time, with or without notice, for conduct that violates these Terms or that we reasonably believe is harmful to Seampli, to the App, or to other users. You may stop using the App at any time by uninstalling it from your device. Provisions of these Terms that by their nature should survive termination — including the safety disclaimers, limitation of liability, release, indemnification, and governing law clauses — shall survive.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, USA, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or related to these Terms or Velocity shall be resolved exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction and venue of such courts. To the extent permitted by law, you waive any right to participate in a class action, class arbitration, or representative proceeding against Seampli.

Force Majeure

Seampli LLC shall not be liable for any failure or delay in performing its obligations under these Terms, or for any interruption, unavailability, or disruption of Velocity, where such failure, delay, interruption, or disruption is caused by circumstances beyond our reasonable control. Such circumstances include, without limitation: acts of God; natural disasters; severe weather; war, terrorism, or civil unrest; government action, embargoes, or sanctions; labor disputes or strikes; failures or outages of internet service providers, hosting providers, or third-party platforms (including Apple's App Store, WeatherKit, App Analytics, or iOS services); GPS or satellite-system degradation or outage; cybersecurity incidents not caused by our negligence; power, telecommunications, or utility failures; and any other event or condition not reasonably foreseeable or preventable by us.

No Waiver

The failure of Seampli LLC to exercise or enforce any right, remedy, or provision of these Terms shall not constitute a waiver of that right, remedy, or provision, nor shall it affect our right to enforce the same right, remedy, or provision at any later time. Any waiver of any provision of these Terms is effective only if it is in writing and signed by an authorized representative of Seampli, and shall apply only to the specific instance and purpose for which it is given.

Updates to These Terms

We may modify or update these Terms from time to time. Material changes will be communicated in-app, through the App Store release notes, or via our website. The current version will always be available at seampli.app/terms/velocity. Your continued use of Velocity after such updates constitutes your acceptance of the revised Terms.

Entire Agreement and Severability

These Terms, together with the Velocity Privacy Policy, constitute the entire agreement between you and Seampli LLC regarding your use of Velocity and supersede any prior agreements or communications relating to the App. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

Compliance Statement

This document has been drafted to align with Apple App Store Review Guidelines (2025–2026), applicable U.S. consumer protection and contract laws, and common-practice disclaimers for consumer GPS, speedometer, and location-tracking applications. It is not a substitute for legal advice from a licensed attorney in your jurisdiction. Seampli LLC recommends reviewing these Terms with qualified legal counsel before relying on them in any dispute.
